Generally, couples undergo IVF to produce their own embryo that will be placed in the uterus of the gestational carrier who will carry the baby until it is born. Using a gestational carrier as part of your infertility treatment can take time. First, clients must find the right carrier for them. Then, the carrier must undergo certain stages of the in vitro fertilization process, which can take three to four months.

Intended Parents' Timetable

The following is a typical schedule for those taking part in the Gestational Carrier/Egg Donor program at our fertility centers in Somerset, Lawrenceville, Annandale, or Freehold, New Jersey:

The intended parents should acquire an attorney who will help the couple review the Gestational Carriers insurance, draft the contract, administer the escrow, and obtain the court order allowing the intended/biological parents to be placed on the birth certificate of the child(ren) resulting from the IVF/Embryo Transfer.
The insurance policy of the intended parents is reviewed with their attorney to determine the extent of coverage available for the medical procedure.
An IVF clinic must be chosen by the intended parents.
The intended parents are screened for any sexually transmitted diseases at the clinic of their choice.
The intended parents obtain a carrier.
The escrow account is set up from which the entire carrier's expenses and payments will be made.
A criminal background check and home study are completed on the carrier and her husband/partner.
The carrier and her husband/partner obtain a psychological and medical evaluation at the clinic.
The insurance policy of the carrier is reviewed by an attorney to determine the extent of coverage available for the carrier.
The contract between the intended parents and the carrier is drafted.
The carrier must receive separate legal representation to protect her interests. Independent counsel is necessary to make sure all parties are comfortable with the arrangement. This lessens the possibility of misunderstandings occurring between the parties.
The contract is signed, the carrier's fee is put into the escrow account and the medical process commences.
If pregnancy is achieved, a court order is obtained in the carrier's resident state (this is possible in many states). It instructs the hospital to place the intended parents' names on the birth certificate of any child born as a result of this arrangement.
An attorney will guide the intended parents through the process of obtaining newborn insurance coverage for the baby's hospital stay after birth.

Qualifications of Melissa B. Brisman, Esq.

Melissa Brisman graduated Valedictorian from the Wharton School of Business at the University of Pennsylvania and graduated with honors from Harvard Law School. She is an attorney admitted to practice in Massachusetts, New Jersey, New York, and Pennsylvania, and is a licensed certified public accountant.

Melissa Brisman first started helping couples become parents of miracle babies in 1996. Actually, she was her own first client, guiding and directing the process in which she and her husband, Dan, became parents of twin boys carried by a gestational carrier. A few years later, they had a daughter carried by another gestational carrier.

Because she is a mother, Melissa is uniquely qualified; she understands the emotion and concern involved in creating a family and is a pioneer and recognized leader in the infertility field. As a lawyer, she has helped hundreds of parents have miracle babies, protecting their legal rights while using all available reproductive technologies.

Melissa is the first attorney to ever obtain orders allowing the genetic parents to go directly on the birth certificate for gestational carrier arrangements in the states of Maine and New Jersey. She argued and won a landmark gestational carrier case before the Supreme Court of Massachusetts and the State Supreme Court of New York, setting legal precedents for birth orders in those states.

She was the first attorney ever to get two women placed on the birth certificate of their child, without an adoption, in the state of New Jersey. Melissa was the first attorney to get two men placed on the birth certificate of a child born through a gestational carrier in the state of Pennsylvania. She has given lectures at many institutions, including: Boston IVF in Waltham, Massachusetts; Reproductive Medical Associates of New Jersey in Morristown, New Jersey; The Mount Sinai Hospital, Mount Sinai School of Medicine, Division of Reproductive Endocrinology in New York City, New York; The Institute for Reproductive Medicine and Science of Saint Barnabas Medical Center in Livingston, New Jersey; and Cornell in New York City, New York.

She has been a keynote speaker for the New Jersey Society for Reproductive Nursing Specialists and the American Society of Reproductive Medicine, and is on the board of the American Fertility Association. She is a professional member of RESOLVE, Organization of Parents Through Surrogacy (OPTS), and the American Society of Reproductive Medicine. Melissa was the recipient of the 2004 Star of RESOLVE Award and is a chapter author of Reproductive Medicine Secrets by Zev Rosenwaks. Currently, Melissa is serving on the Advisory Board of Conceive Magazine. She is also the author of numerous articles on the subject of reproductive law.

Melissa drafts and negotiates contracts for many types of reproductive arrangements, including gestational carrier contracts and egg, sperm, and embryo donor contracts.
